Former Vice President Atiku Abubakar and the African Democratic Congress (ADC) have sought to amend their legal challenge against President Bola Tinubu’s eligibility to participate in the 2027 presidential election, with the Federal High Court in Abuja scheduling October 13, 2026, to consider the application.
The case also lists the All Progressives Congress (APC) and the Independent National Electoral Commission (INEC) as defendants.
The suit, filed as FHC/ABJ/CS/1888/2026, came up for further mention before Justice Inyang Ekwo.
At the hearing, counsel representing the plaintiffs, Joseph Silas, informed the court that all the defendants had been served with the necessary processes within the required timeframe, adding that the plaintiffs had also received and responded to the defendants’ filings.
The case had earlier been delayed over a disagreement concerning the service of court processes on the first defendant.
Counsel to the President, Chief Wole Olanipekun (SAN), reminded the court that during the previous hearing on September 1, 2026, counsel to the second defendant, Popoola Owosanya, had indicated his willingness to accept the court processes on behalf of the first defendant.
Olanipekun said the plaintiffs’ lawyer declined the offer and subsequently applied to the court for permission to serve Tinubu through substituted means, claiming that the plaintiffs later attempted to “deceive this court” by alleging that they could not serve the first defendant.
Justice Ekwo, however, directed the lawyers to concentrate on the matter scheduled for the day.
Silas then brought the court’s attention to the plaintiffs’ application seeking permission to amend their originating summons. He added that lawyers representing the defendants had been duly notified of the application.
