2027 Poll: Supreme Court Reserves JudgmentI INEC, ZLP Legal Tussle On Electoral Act – Independent Newspaper NigeriaThe Supreme Court has reserved judgment in a major electoral dispute brought by the Independent National Electoral Commission, INEC, over provisions of the Electoral Act 2026. The case is attracting considerable attention because the provisions at the centre of the legal battle relate directly to the way political parties maintain their membership registers and nominate candidates for elections. A seven-member panel of the apex court heard arguments from the parties before reserving judgment.

The dispute followed an earlier decision of the Court of Appeal which voided some of the provisions contained in the new electoral law. INEC subsequently approached the Supreme Court, asking the apex court to determine whether the Court of Appeal was right in nullifying the provisions. The commission’s position is being closely watched because the interpretation of the law could affect the way political parties organise their internal processes ahead of the 2027 general elections.

At the heart of the dispute is the question of how political parties should manage their membership records and the procedures through which candidates emerge. Party membership registers are important because they provide the basis for determining who belongs to a political organisation and, depending on the applicable rules, who may participate in party activities. Candidate nomination is equally sensitive because disputes arising from primaries and nomination processes have historically generated substantial litigation.

The timing of the case makes the Supreme Court’s eventual decision particularly significant. Political parties are already positioning themselves for the 2027 elections, while aspirants are beginning to organise support and seek nominations. A definitive interpretation of the Electoral Act could therefore provide greater clarity for INEC, political parties, candidates and voters. Until judgment is delivered, however, the legal questions remain before the court and no final determination has been made on the disputed provisions.
